It is now more important than ever that our Captiva and Sanibel communities attend these hearings to have their voices heard. We want the Hearing Examiner to understand why the community has so strongly opposed the efforts by South Seas to increase the 912-density cap on the resort by 356 units. We also want the Hearing Examiner and the Board of County Commissioners to approve no more than 912 units for the resort (with 272 units for Timbers) so that this litigation can end – and South Seas can focus on rebuilding at the density limits about which they were told before they purchased their 120 acres of the resort.
The hearings will take place at 9 a.m. in the Chambers of the Board of County Commissioners located at 2120 Main Street, Fort Myers. On Feb. 14, South Seas will present its application and County Staff will begin to present its position on the application.
The case against the application prepared by attorneys for CCA and the Community Associations on South Seas (including public participation) will most likely begin on Feb. 20 – but it depends upon the length of the South Seas and County Staff presentations. It could start on Feb. 14.

If you cannot attend the hearings and wish to voice your concerns, you can authorize someone to represent you at the hearings by filling out the attached Agent Authorization Form, by having it notarized, and by providing a written statement to your authorized agent. Lisa Riordan (President of CCA), Ken Suarez (President of Presidents’ Council) or anyone else you choose who will be in attendance can be authorized as your agent. Notarized authorizations for agents Lisa Riordan and Ken Suarez, with your statement, should be emailed to [email protected]. By following this procedure, you preserve your right to speak on this matter before the Board of County Commissioners.
